Mass timber manufactures are NOT Trades and CANNOT be engaged with a subcontract. Mass Timber suppliers are material SUPPLIERS, and they need to be engaged with a Material Supply Agreement.

You may want to apply your experience purchasing steel structure, but this experience does not apply, unless your mass timber supplier is carrying the erection.

Until you have boilerplate MSA’s that you can use, you will continue to have two options:

  1. Sign the suppliers Purchase Order agreement (your lawyers rarely likes this option).
  2. Engage in a long, drawn out, onerous negotiation process while we systematically pour over your subcontract agreement and forcefully change it into a Material Supply Agreement.

Make purchasing mass timber easier on yourself – make sure your company has a standard Material Supply Agreement in place.
